NOTICE
TO EMPLOYEES
POSTED PURSUANT TO A SETTLEMENT AGREEMENT APPROVED
BY A REGIONAL DIRECTOR OF THE NATIONAL LABOR RELATIONS BOARD
FEDERAL LAW GIVES YOU THE RIGHT TO
Form, join or assist a union;
Choose representatives to bargain with us on your behalf;
Act together with other employees for your benefit and protection;
Choose not to engage in any of these protected activities.
WE WILL NOT do anything that restrains or
coerces employees in their exercise of these rights.
More specifically,
WE
WILL NOT threaten employees with loss of work opportunities,
threaten to expel them from membership, bring charges against
them, or fine and/or threaten to fine them because they make
protected concerted inquiries with an employer regarding work
opportunities afforded under the collective bargaining agreement
we have with that employer and WE WILL NOT deny opportunities
to employees because their co-workers make such protected
concerted activities.
WE
WILL NOT attempt to cause an employer to discriminate
against its employees because of the employees' involvement
in proceedings with the National Labor Relations Board.
WE
WILL NOT refer employees to fill positions at the
Boston Herald without applying objective criteria in the selection
process.
WE
WILL NOT maintain the "closed shop" clause
in the first paragraph of Appendix A of the collective-bargaining
agreement, we have with Boston Herald where it states that
the Boston Herald will employ only our members in good standing.
WE
WILL request The Globe Newspaper Co. to modify the
language that appears in Section III. D 3) of the supplemental
agreement to our collective-bargaining agreement to so that
the priority given to Herald and Lynn Union members is changed
to give the priority to Herald bargaining unit employees.
WE
WILL agree to delete or cross out the first paragraph
of Appendix A from all of our copies of the collective-bargaining
agreement we have with the Boston Herald.
WE
WILL rescind the charges that were brought against
our member Joseph Donelli and the fine notification letter
dated September 2, 2005 that we issued to him and
WE
WILL notify Donelli in writing that we have done
so.
WE
WILL rescind and inform the Boston Herald that we
are rescinding our August 2005 referral of the individuals
to fill the newly created priority substitute and extra positions
and
WE
WILL solicit employees in the bargaining units of
the Boston Herald and Boston Globe, including employees who
held the position of trainee at the Boston Globe and extra
at the Boston Herald as of July 20, 2005 to apply for these
vacant positions at the Boston Herald.
WE
WILL make whole Rosemary Broderick for all economic
losses she sustained as a result of our not providing her
with work opportunities.
WE
WILL make whole Joseph Arsenault, John Ryan and Henry
Zellen for all economic loses they sustained as a result of
our not referring them for one of the available Boston Herald
priority substitute and/or extra positions.

you want to apply to the Boston Herald for a job as an extra
or priority sub in the
Herald Mailroom, please do the following:
- Pick
up an Employment Application Form available at the Boston
Herald.
- Complete
the Form fully and accurately.
- Return
the Form to the Boston Herald.
- The
Herald is solely responsible for the selection of extras
and priority
subs to be employed from among the applicant pool and the
persons who
have filled these positions since September, 2005.
